These are the current terms and conditions of RedBalloon NZ Limited "RedBalloon" and they apply to the use of any voucher, whether or not the voucher holder is the original purchaser. Please contact us should you require further information or a detailed explanation of any of the terms and conditions below:

  • The program is operated on behalf of Adam Parore Mortgages by RedBalloon Days.
  • The rewards program runs from 1 May 2006 until notified by Adam Parore Mortgages.
  • All referrals resulting in settled loans from this date will be valid for points.
Interpretation
In these terms and conditions where the context permits:
  1. 'Experience Voucher' means a voucher for a specific experience, for example, hot air ballooning, karting or scuba diving.
  2. 'Range Voucher' means a RedBalloon Red, Bronze, Silver or Gold voucher which allows the recipient to choose their own experience from a range.
  3. 'Gift Certificate' is a voucher with a dollar value that can be used to purchase (an) experience/s on the RedBalloon website.
  4. 'Redeemed' means that the recipient has activated their voucher and requested dates to take their experience.
TERMS AND CONDITIONS OF PURCHASE
Contract
When you purchase or redeem a RedBalloon voucher and tick the box that says 'I understand and accept the terms and conditions'. You become legally bound by these terms and conditions. Please do not proceed and purchase or redeem a voucher until you have read, understood and accepted the terms and conditions.

Prices
We reserve the right to change prices without notice. All prices include Goods and Services Tax (GST) at the current rate of 12.5%.

Transfer of vouchers
RedBalloon range vouchers, experience vouchers, promotional vouchers and gift certificates are fully transferable until redeemed. RedBalloon accepts no responsibility for lost, stolen or fraudulent vouchers. It is the holder's responsibility to ensure the safe keeping of the voucher(s) or gift certificate(s).

Validity of Experience Vouchers
Our vouchers for specific experiences, for example Hot Air Ballooning must be used within 6 months of purchase. Voucher extensions are available only if the experience is still listed on the website and the circumstances in which they apply are outlined below. Please note however, extensions attract administration fees, so it is in your interest not to let your voucher expire.
Extension Circumstances
  1. If your voucher has not yet expired, and you cannot take the experience before the expiry date, we can extend your voucher for an administration fee of $10 per month per voucher for a maximum of three months only.
  2. If your voucher has already expired and you contact us within 30 days of its expiry we can extend it for an administration fee of $50 for one month only.
  3. If your voucher has already expired and you contact us more than 30 days after the expiry of your voucher the voucher cannot be extended under any circumstances. Expired vouchers are non-refundable in whole or in part.

Our Range Vouchers (i.e. Red, Bronze, Silver and Gold vouchers) must be used within 12 months of purchase. Voucher extensions are available and the circumstances in which they apply are outlined below. Validity of Gift Certificates
Our Gift Certificates must be used within 12 months of purchase* and cannot be extended.
*Exceptions apply, please see below:
  1. If a gift certificate was issued prior to 1 November 2005 and is within 30 days of the expiry date, we can extend the gift certificate for a maximum of 30 days for an administration fee of 10% of the value of the certificate. Any gift certificate over $500 will have a capped administration fee of $50.
  2. If your gift certificate was issued prior to 1 November 2005 and you contact us more than 30 days after the expiry date. The gift certificate cannot be extended. Expired gift certificates are not redeemable for cash and are not refundable.
Refund and exchange policy
All RedBalloon vouchers and gift certificates are non-refundable and not exchangeable/redeemable for cash.

Valid vouchers that have not yet been redeemed (i.e. if booking dates have not been requested) may be exchanged for another experience once only without attracting a fee. All subsequent exchanges will incur an administration fee of $10 per voucher.

If you exchange your voucher for an experience of lesser value - any remaining balance will be held in credit and subject to expiry date as the original voucher. The expiry date of any exchanged voucher is the same as the original voucher.

If you exchange your voucher for an experience of higher value - you will be required to pay the difference. The expiry date of any exchanged voucher is the same as the original voucher.

Voucher delivery service via email
RedBalloon vouchers are delivered by email to the email address entered by the purchaser. Some email accounts (especially work email and Hotmail accounts) may categorise our email vouchers as unwanted or 'spam' email. To avoid this please add our email address info@redballoondays.co.nz to your address book.

RedBalloon is not liable or responsible for any loss suffered as a result of an email voucher being blocked by web filters or firewalls. If the recipient does not receive the email voucher, please contact our dedicated team immediately to send vouchers to an alternative email address. Alternatively, we can change the delivery method which would incur the normal delivery fee of that service.

Voucher delivery service via TNT Express
Vouchers are delivered by TNT express international services from our Sydney NSW Australia office. We can provide you with the consignment note number to view the status of delivery. We accept no responsibility for TNT Express service. Delivery charges are non-refundable.

A re-delivery charge of $6 will apply if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

We are not liable for any loss suffered as a result of a voucher being lost in the delivery process.

Voucher delivery service via courier
RedBalloon offers a courier service to metropolitan areas of major cities on business days only.

Orders for couriers need to be placed before 12.00pm EST three days prior to the required delivery date.

We contract our deliveries to various courier companies. A re-delivery charge of $20 will apply if the recipient is unavailable for receipt of delivery, if an incorrect delivery address is given or if there is no safe place to leave the consignment.

We are not liable for any loss suffered as a result of a courier voucher being left in a safe place or balloons deflating or popping.

TERMS AND CONDITIONS OF REDEMPTION
Agency
Vouchers are sold by RedBalloon as agent for businesses that provide lifestyle and recreational services to customers. RedBalloon is not a provider of services and has no responsibility for any services provided or not provided by any other party. RedBalloon makes no warranty or representation regarding the standard of any service to be provided. All RedBalloon vouchers are issued subject to the terms and conditions of each business and these terms. We do not have any power to control suppliers' operations. We take all reasonable precautions to ensure that the suppliers we promote are safe and reliable. However, we make no guarantees or warranties about the services that are provided to you by suppliers. RedBalloon acts as agent only. The suppliers provide services to customers directly.

Liability
RedBalloon has no liability for any act, omission or default, whether negligent or otherwise, of any service provider. RedBalloon has no liability for any loss or damage occasioned by any negligent act or omission of any service provider or third party. Where RedBalloon's liability cannot be excluded, such liability is limited to the value of the voucher purchased.

Availability
All services are offered by suppliers subject to availability. Bookings should be made at least 3 weeks in advance. If you would like to book during peak times (such as weekends or holidays), you should book further in advance. Bookings are not finalised until you have received the email entitled Confirmation of your booking from RedBalloon. Please be advised that some experiences display availability dates on the website. These dates are guidelines only and are subject to change. We suggest if you plan to purchase a voucher for a date listed a short notice, you call us to ensure there is still availability before completing the transaction.

Cancellation
Once your booking has been made, if you cancel it, you may incur a cancellation fee from the supplier involved. Our suppliers operate under their own cancellation policies which you will need to adhere to. In the case of short notice cancellations you may lose your voucher completely if the supplier is unable to fill your space on the day. If a supplier needs to cancel a service for any reason, you will be notified as soon as possible in order to reschedule a convenient alternative date. RedBalloon will not reimburse any travelling, accommodation or other expenses incurred by you or any other person in the event of a cancellation.

The weather
Many experiences are weather dependent. You will have the supplier's details so you can call to confirm whether adverse weather has been forecast by your supplier on the morning of your experience. If bad weather affects a booking it will be rescheduled at no cost to you. You are required to reschedule as the voucher is non-refundable.

Complaints/problems during your experience
If you have a problem or a complaint on the day of service, please bring it to the supplier's attention at your earliest opportunity preferably on the day of your service.

Insurance
The very nature of some of the services that we promote as agent means that they are dangerous. Prior to ordering or participating in any service you should be aware of the risks involved. RedBalloon can provide further information if you are in any doubt about any service. We require our service providers to hold appropriate and valid public liability insurance before we will promote their services as agent and we make no warranty or representation about their services whatsoever. Responsibility rests with you to make independent enquiries with the supplier and other third parties as to the need to acquire your own insurance cover.

Service descriptions
Independent service providers provide the information about their services. We try to ensure that our promotional information is accurate and up-to-date. However, the content or format of some services may change slightly from time to time. The company providing the service (upon confirmation of each booking) will provide the final details about each service. The relevant company will notify you of any subsequent changes. Your participation in each service is conditional upon your acceptance of the providing company's terms at the time your booking is confirmed.

Illustrations
The photographs used in any advertisement to illustrate multi-location services are provided to us by suppliers and are used as an indication only as the machines, vehicles, craft, animals and specific locales vary.

Venues
RedBalloon suppliers are located at many of New Zealand's best locations. We are continually adding locations but occasionally we may need to stop featuring some venues. Where locations are described as "New Zealand-wide," the description is indicative only. Some services may not be available in remote areas.

Session lengths
Session lengths are approximate and are given by suppliers as a guide to the total time you will be at their venue. Unless otherwise stated, you will normally take your turn with the supplier's other customers and there may be waiting time involved. Any itinerary provided to you is indicative only and the order of events may change.

Restrictions
Certain services provided by suppliers are subject to minimum age, health or other requirements. These details are featured at the time of the redemption of your voucher. Please read this information carefully once you have received it and notify us within seven days if any service is unsuitable. Once you have confirmed a booking you may be liable for supplier and/or agency charges if you are forced to cancel because the minimum requirements are not met. Details of each supplier's requirements are set out on the RedBalloon website under each service. Please read them carefully.

The text and illustrations (including photographs) used by RedBalloon are protected by copyright and must not be copied in whole or in part with the express permission of RedBalloon NZ Limited.
